Dear TOA Member:
On May 18, 2016, the U.S. Department of Health and Human Services (HHS) issued a final rule regarding the Affordable Care Act’s non-discrimination policies in Section 1557. Click here to read a very lengthy summary from the Kaiser Foundation.
The provision requires covered entities (physician practices) to post a notice regarding discrimination and patient rights by October 16, 2016. It must include “taglines” in the top 15 languages spoken in the practice’s state.
Joseph Mathews of Advanced Orthopaedics & Sports Medicine provided a sample discrimination statement that his practice is using. Click here to view it. Please note that this is provided for informational purposes only and does not serve as professional advice. Please consult your compliance professional.
Not all of the languages translated to the PDF document. If you would like the Word Document version, please click here.
“Assurance of Compliance” Deadline – October 19, 2016
Section 1557 also requires practices to complete an “assurance of compliance” attestation by October 19, 2016. Click here to complete it on the HHS website.
